TERMS OF SERVICE

Effective Date: January 1, 2012 · Last Updated: June 18, 2026
MY WORKSHOP — Yasmina EL Babarti Jimenez, Int’l CPC – CBC – CELC — Montréal, Québec, Canada
myworkshopmycoach.com · info@MyWorkshopMyCoach.com · 1-438-524-4797

Please read these Terms of Service carefully before engaging MY WORKSHOP or using this website. By requesting a service, participating in an alignment call, or entering into a written agreement or Statement of Work (SOW) with us, you confirm that you have read and agree to be bound by these Terms.

1. ABOUT MY WORKSHOP

MY WORKSHOP is a professional coaching, facilitation, and leadership training practice operated by Yasmina E. Jimenez (Int’l CPC – CBC – CELC), a sole proprietor based in Montréal, Québec, Canada. We serve individuals, corporations, non-profit organizations, government departments, Crown corporations, and international institutions across Canada and worldwide.

As a member of the International Coach Federation (ICF), MY WORKSHOP practices in accordance with the ICF Code of Ethics and Core Competencies, which are incorporated by reference into all coaching engagements.

2. DEFINITION OF COACHING

Professional Coaching is an ongoing professional relationship that helps people produce extraordinary results in their lives, careers, businesses, or organizations. Through the process of coaching, clients deepen their learning, improve their performance, and enhance their quality of life. In each session, the client chooses the focus of conversation, while the coach listens and contributes observations and questions. This interaction creates clarity and moves the client into action.

Coaching accelerates the client’s progress by providing greater focus and awareness of choice. It concentrates on where clients are now and what they are willing to do to get where they want to be. ICF member coaches recognize that results are a matter of the client’s intentions, choices, and actions, supported by the coach’s efforts and application of the coaching process.

Coaching is not therapy. MY WORKSHOP coaching and training services are not psychotherapy, psychological counseling, or mental health treatment. Clients are always free to reject any suggestion made by the coach. If at any point a client requires mental health support, MY WORKSHOP will provide appropriate professional referrals.

3. SERVICES OFFERED

MY WORKSHOP provides the following professional services:

  • One-on-one and group executive coaching (individual, package, or program-based)
  • Leadership and professional development training
  • Team facilitation and organizational workshops
  • Organizational development consulting

Services are delivered virtually (via Microsoft Teams or other agreed platforms), by telephone, by email, or in person, as negotiated between the client and MY WORKSHOP.

4. FAITH-BASED AND NON-FAITH-BASED SERVICES

MY WORKSHOP offers both faith-based, Christ-centred coaching and training, and non-faith-based, secular coaching and training. The approach taken in any engagement is determined entirely by the client’s or sponsoring organization’s request, as documented in the coaching agreement or SOW.

MY WORKSHOP serves clients of all beliefs, faiths, cultural backgrounds, values, and diversity dimensions. The coaching relationship is centred on the coachee — their goals, their growth, and their autonomy. No particular worldview is imposed. Respect for each individual is foundational to everything we do.

5. CLIENT AND SPONSOR — ROLES AND RESPONSIBILITIES

In accordance with the ICF Code of Ethics, MY WORKSHOP distinguishes between the following roles:

  • Client (Coachee): The individual receiving coaching services.
  • Sponsor: The employer, organization, or third party that arranges for and/or funds the coaching engagement on behalf of the coachee.

When the client and sponsor are different parties, the coaching agreement will clearly establish the rights, roles, and responsibilities of each. The coachee’s session content remains strictly confidential from the sponsor, except for administrative information as explicitly agreed in the contract. Sponsors are responsible for ensuring that the coachee is aware of and has consented to the coaching engagement and its terms.

6. ENGAGEMENT — CONTRACT REQUIRED

No coaching, training, or facilitation mandate is binding until a written agreement, coaching contract, or Statement of Work (SOW) has been signed or confirmed in writing. The process is as follows:

  • An alignment call is held between MY WORKSHOP and the client or sponsor to establish fit, scope, and expectations.
  • A coaching agreement, proposal, or SOW is prepared and shared for review.
  • The engagement begins only upon written confirmation of the agreement and, where applicable, receipt of a deposit.

No payment, deposit, or commitment is requested or accepted prior to a completed alignment call and a signed or confirmed agreement. Verbal discussions alone do not constitute a binding engagement.

7. COACHING PACKAGES AND SESSION STRUCTURE

MY WORKSHOP offers flexible coaching engagements including individual sessions and structured packages (e.g., 4-1-1, 6-1-1, 9-1-1 session packages; 90-Day Action Plan; Business Bootcamp programs). The specific package, number of sessions, session length (typically 60 minutes), and program duration are confirmed in the coaching agreement.

  • Sessions are scheduled at a mutually agreed-upon cadence (weekly, bi-weekly, or monthly).
  • Sessions are conducted via Microsoft Teams, by telephone, or in person as agreed.
  • Unused sessions within a package period will not be carried over past the agreement end date and will be forfeited.
  • Between sessions, clients are welcome to reach out by email or phone for brief guidance, within reasonable limits.

8. FEES, PAYMENT, AND CURRENCY

Fees are set out in the applicable coaching agreement, proposal, or SOW. The following terms apply:

  • Deposit: A deposit of 25% of the total engagement fee is required before the first session. No session begins without an agreed contract and confirmed deposit.
  • Balance payment options: The remaining balance may be paid in full before the program begins, or divided into monthly instalments (typically up to six monthly payments). Early payment is welcome at any time.
  • Currency: Fees may be invoiced in Canadian dollars (CAD), US dollars (USD), or Euros (EUR), as agreed. For clients paying in other currencies, MY WORKSHOP will provide a mutually agreeable payment solution on a case-by-case basis. All applicable exchange rate and transaction fees are the responsibility of the client unless otherwise specified in the agreement.
  • Payment methods: Electronic bank transfer (e-transfer for Canadian clients), post-dated cheques mailed to MY WORKSHOP, or credit/debit card via Stripe.
  • Taxes: Applicable taxes (GST/HST/QST) will be added where required by Canadian law. International clients are responsible for any taxes or import duties applicable in their own jurisdiction.
  • Late payments: Late payments may be subject to interest at 1.5% per month (18% per annum) on the outstanding balance.
  • Receipts: Invoices and receipts are issued according to the agreed payment schedule.

9. RESCHEDULING AND MISSED SESSIONS

  • Clients are expected to make coaching sessions a priority and to connect promptly at the scheduled time.
  • Rescheduling requests must be provided at least 24 hours in advance. MY WORKSHOP will work with the client to find a suitable alternative time.
  • If a client does not reschedule within 24 hours or fails to connect within 15 minutes of the scheduled start time, the session will be considered forfeited and may be charged in full.
  • If extended travel or schedule changes are anticipated, clients should notify MY WORKSHOP in advance.
  • If MY WORKSHOP must cancel a confirmed session due to circumstances within our control, a replacement session will be offered at no additional cost.

10. TERMINATION AND EARLY WITHDRAWAL

  • Clients may choose to discontinue coaching at any time. A minimum of one month’s written notice is requested for ongoing or long-term engagements.
  • Fees for sessions already held are non-refundable. Prepaid fees for future sessions within a package may be credited or refunded at MY WORKSHOP’s discretion.
  • MY WORKSHOP reserves the right to suspend or terminate an engagement if circumstances arise that make it ethically inappropriate to continue, in accordance with the ICF Code of Ethics. Appropriate professional referrals will be provided.

11. SESSION RECORDING AND ICF CERTIFICATION

With the client’s explicit prior written consent, coaching sessions may be recorded. Recordings are used solely for coach mentoring or ICF credential evaluation. This consent is documented in the coaching agreement. Clients may withdraw consent at any time by notifying MY WORKSHOP in writing.

12. CONFIDENTIALITY

Confidentiality is the foundation of the coaching relationship. Everything discussed in sessions — personal insights, career and business goals, proprietary information, organizational matters, or personal circumstances — is held in strict confidence.

  • MY WORKSHOP will not disclose coaching session content to any third party, including a sponsoring employer, without the coachee’s explicit written consent.
  • The confidentiality obligation does not apply where disclosure is required by law, court order, or regulatory authority, or where MY WORKSHOP has reasonable grounds to believe that the client or another person is at risk of serious harm.
  • Clients agree to treat any proprietary tools, frameworks, materials, or methodologies shared by MY WORKSHOP as confidential and not to reproduce or distribute them without prior written permission.

13. CLIENT RESPONSIBILITIES AND INFORMED CONSENT

By engaging MY WORKSHOP, clients understand and agree to the following:

  • The client is fully responsible for their own well-being, choices, and decisions during and between coaching sessions.
  • Coaching is not therapy. The client agrees to seek licensed mental health support independently if needed, and MY WORKSHOP will provide referrals upon request.
  • The client will inform MY WORKSHOP if they are under the care of a licensed healthcare provider or are taking prescribed medication, to the extent it may affect the coaching engagement.
  • The client agrees to participate with honesty and in good faith, and to take responsibility for their own progress and results.
  • The client is free to reject any advice, suggestion, or request made by the coach at any time.
  • Sponsors are responsible for ensuring appropriate facilities, technology, and availability for the coachee to participate in sessions.

14. INTELLECTUAL PROPERTY

All content, materials, tools, frameworks, slide decks, workbooks, and resources created by MY WORKSHOP and provided during engagements remain the intellectual property of MY WORKSHOP unless otherwise agreed in writing. Clients receive a limited, non-exclusive licence for their own internal use only. Reproduction, redistribution, or resale without prior written permission is prohibited.

We are not liable for indirect, incidental, consequential, or punitive damages.

17. ICF CODE OF ETHICS

MY WORKSHOP operates in accordance with the ICF Code of Ethics, including standards of professional conduct, conflict of interest avoidance, confidentiality, and culturally sensitive practice.
